Estate Planning

Estate planning is necessary to ensure that your assets are passed to your intended beneficiaries. We will listen to you and learn your goals to develop a plan which will ensure that your wishes are followed. Estate planning involves the preparation of documents such as wills, trusts, general power of attorney, healthcare power of attorney, living will declarations and related documents. Our attorneys have extensive knowledge to guide clients with simple estate plans involving minimal assets or with complex estate plans which may include foreign property and substantial assets involving significant tax implications.

From startup to dissolution, our attorneys can assist in all of your business entity’s legal matters which replace the need for expensive, in house counsel. We have assisted numerous for profit and not for profit clients in entity selection to achieve the best legal and tax benefits. We continue to work with many of these clients in drafting necessary contracts for their daily operation, significant transactions, as well as mergers and acquisitions. Should the need arise, we provide skilled advice for dissolving your business entity to avoid incurring personal liability whenever possible.

Losing a loved one is never easy and the stress of administering an estate can become overwhelming. Levy & Associates can guide you through the complicated probate court system, and stand ready to do what it takes to settle the estate, whether it involves a simple transfer of property or complex litigation. Effective estate administration involves many factors, including federal and state income and estate tax laws as well as any potential international implications of a particular plan’s provisions. Time and again, our attorneys have been trusted during emotionally difficult times to ensure the efficient and orderly administration of estates of all sizes.

Guardianship is a multifaceted area of law with complexities that are often overlooked by those unfamiliar with its demands. Whether assisting a minor child receiving a settlement or an adult who lacks capacity to make sound personal, medical or financial decisions, our attorneys have the knowledge to guide clients through the process to establish the necessary guardianship. Our attorneys continue to work with clients after the establishment of a guardianship to ensure all required yearly filings are properly completed in a timely manner and to ensure compliance with all laws. When necessary, our attorneys have the experience to create Special Needs Trusts and other legal instruments to protect the client’s ability to receive government benefits or to enable them to qualify to receive such benefits.

Grandparent Rights

When grandparents step forward to become full time caregivers for their grandchildren, they may face challenges from their child or in-laws who later wish to assert custody rights. Unless parental rights have been terminated, or unless other legal procedures have been followed, grandparents may lose custody or visitation to their grandchildren. Our attorneys have tenaciously represented grandparents in this growing area of law and will work to protect and preserve the relationship between the grandchild and grandparent.

The goal of mediation is to use the assistance of a neutral third party to reach an agreement that meets the needs of both parties without the financial and emotional cost of court proceedings. Our mediators guide discussion in an effort to resolve issues. The mediator does not represent either party and cannot provide legal advice. Any type of case can be mediated, including: divorce, partnership dissolutions, custody disputes and many more areas of conflict. Levy & Associates has mediators certified for county court, circuit civil, dependency and Appellate mediation for the Fifth District Court of Appeal in Florida.
